General Terms and Conditions

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers and entrepreneurs (hereinafter "Customers") through the online shop of Colour of Sport, Birkenweg 11B, 53797 Lohmar, Germany (hereinafter "Provider").

1.2 A consumer, within the meaning of these GTC, is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity. An entrepreneur, within the meaning of these GTC, is a natural or legal person or a legal partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

2. Contractual Partner, Contract Conclusion

2.1 The purchase contract is concluded with Colour of Sport, Birkenweg 11B, 53797 Lohmar, Germany.

2.2 The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to order. By clicking the "Order" button, you place a binding order for the items in the shopping cart. The confirmation of receipt of your order is sent by email immediately after the order is placed and does not yet constitute acceptance of the contract. We can accept your order by sending an order confirmation by email or by delivering the goods within five days.

3. Prices and Shipping Costs

3.1 The prices listed on the product pages include statutory VAT and other price components.

3.2 In addition to the stated prices, we charge shipping costs for delivery. These shipping costs are clearly communicated to you on the product pages, in the shopping cart system, and on the order page.

4. Delivery Conditions

4.1 Delivery is made worldwide.

4.2 The delivery time is stated on each product page and under the section shipping and returns. Any differing delivery times will be indicated on the respective product page.

5. Payment

Payment is made in advance, via PayPal, or by credit card.

6. Retention of Title

The goods remain our property until full payment is made.

7. Right of Withdrawal

7.1 Consumers have a statutory right of withdrawal for fourteen days.

7.2 The right of withdrawal does not apply to the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.

8. Warranty and Guarantees

8.1 Statutory warranty rights apply.

8.2 Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

9.1 We are always fully liable for claims due to damages caused by us, our legal representatives, or agents:

- in the event of injury to life, body, or health,

- in the event of intentional or grossly negligent breach of duty,

- in the case of guarantee promises, if agreed,

- insofar as the scope of the Product Liability Act is opened.

9.2 In the event of a breach of essential contractual obligations, whose fulfillment is a prerequisite for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely, through slight negligence by us, our legal representatives, or agents, the liability is limited to the foreseeable damage typical for the contract at the time of the contract conclusion. Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR). This gives consumers the opportunity to settle disputes related to their online orders initially out of court.
